Purpose of the form
MBD 8 — Declaration of Bidder's Past Supply Chain Management (SCM) Practices asks the bidder to confirm whether the entity, its directors or shareholders have:
- been listed on the National Treasury Database of Restricted Suppliers (blacklisted)
- been listed as a tender defaulter under the Prevention and Combating of Corrupt Activities Act
- had a contract terminated in the past five years for poor performance
- abused the SCM system
- committed fraud or any other improper conduct in relation to such system
What bidders should review before answering
- Check the National Treasury Database of Restricted Suppliers for both the company and individual directors.
- Check the Register of Tender Defaulters maintained by National Treasury.
- Review the past 5 years of contracts for any termination, settlement, or formal complaint.
- Confirm with directors whether any have served on a board of an entity that was blacklisted.
Common issues
- Bidders unaware that an old, dormant company they were directors of was blacklisted.
- Confusing dispute with termination for poor performance — only specific terminations need to be disclosed; check the wording.
- Marking NO without actually checking the register.
Integrity warning
A false MBD 8 declaration is treated as fraud. Penalties include:
- Disqualification from this tender
- Listing on the Database of Restricted Suppliers (10 years possible)
- Criminal sanction under the PFMA / Prevention and Combating of Corrupt Activities Act
